Executive Summary
- The Affordable Care Act (ACA) has already been ruled unconstitutional by a federal district court, a decision that will be reviewed by the U.S. Supreme Court in March 2012.
- Mississippi is party to a 26-state lawsuit challenging the constitutionality of ACA.
Another federal court has now recognized that Congress does not have the authority to force Americans to buy a product. It is sad that so many people in Congress failed to read the text and history of the Constitution before they approved the massive health care overhaul bill last year, which included a provision requiring all Americans to buy health insurance. The health care reform bill now moving through the U.S. Senate includes an individual mandate, which means that if you are not covered by your employer, you will be forced to buy an insurance policy. That policy will have to cover everything Congress thinks you ought to have, which means high-powered lobbyists, and the politicians and bureaucrats they influence, will determine the diseases and devices your policy covers. Glossary of Insurance Terms
Adverse Selection: The tendency for people with greater needs to be more likely to sign up for insurance, or to enroll in one plan over another, resulting in a health insurance pool containing a disproportionate share of people with medical conditions. Such a situation leads to higher premiums, which will drive healthier people out of the pool. (more…)
